Freetown — Sierra Leone Football Association (SLFA) and premier league side, FC Kallon will today appear in high court following an injunction filed in by the premier league side.
FC Kallon officials have earlier protested against SLFA appeals committee for not taking decision in their protest against Mighty Blackpool over striker, Alex Sesay aka Sixties.
However, SLFA has hit back at FC Kallon stating that they have violated the football constitution by taking the association to court.
According to SLFA constitution article 65, "SLFA shall create an arbitration tribunal which shall deal with all internal national disputes between SLFA, its members, players, officials, matches and players' agents. The executive committee shall draw special regulations regarding the composition, judicial and procedural rule of this arbitration tribunal." Also article 66 section (1) of the constitution stated that "SLFA, its members, players, officials and match players agent will not take any dispute to ordinary court unless specifically provided for in these statues and FIFA regulations. Any disagreements shall be submitted to the jurisdiction of FIFA, CAF or SLFA." Section (II) of article 66, stated that "SLFA shall have jurisdiction on internal national dispute. i.e.
dispute between parties belong to SLFA. FIFA shall have jurisdiction on international dispute." FC Kallon's team manager, Tunde Scott told Concord Sports that due to the no compliance by SLFA to their protest, they decided to forward the matter in high court." "They never replied us since October, we have the right to drag them to court because SLFA is a limited company," Scott said.

it is my opinion that FC Kallon had the right to bring action against SLAFA. Well from the legal point of view, the provisions relied upon by SLAFA are called ouster clauses, and the attitudes of courts regarding ouster clauses are very strict, and they can give way in the intrest of justice, equity and good conscience.
Besides, the Superior courts of judicature in Sierra Leone, especially the High Court has supervisory jurisdiction over all tribunals in Sierra leone see the case of APC & ors. vs. The Speaker of Parliament & ors.
